SB 558 (2024)
Require insurance coverage for some fertility treatment, prohibit employer discrimination related to fertility/infertility
Provides insurance coverage for infertility treatments. This bill then adds protections against employer discrimination during IVF treatments, parental leave, and adoption. This bill also states that an employer cannot require an employee to use accrued paid time off before receiving parental leave.
The Senate rewrote the bill. The new bill provides insurance coverage for up to 6 rounds of intrauterine insemination per plan year regardless of whether or not the individual has a diagnosis of infertility. The bill then prohibits employers from discriminating against employees for taking time related to fertility treatment or pregnancy loss. The bill also specifically requires employers to allow employees to take time off for well-being checkups, in-vitro fertilization follow up, and postpartum care.
