HB 373 (2025)

Require supermajority vote to rent or lease real property owned by the town for more than 5 years

Summary:

Requires a 3/5 majority vote of a select board to rent or lease real property owned by the town for a period of more than one year. This bill also authorizes a town, through a 3/5 majority vote, to grant or rescind their select board's authority to rent or lease any municipal property under their control for a term of up to 5 years.

The House revised the bill to do three things. First, the bill allows select boards to enter lease agreements under 1 year without approval from town voters. Second, the amended bill requires town voters to approve their select board's authority to rent or lease any municipal property for 1 to 5 years. Lastly, the amended bill requires a 3/5 majority vote of town voters to rent or lease real property owned by the town for a period longer than 5 years.
