Require notification on rulemaking, some payment of attorney fees
Makes various changes to the Administrative Procedures Act, generally limiting the rulemaking authority of state agencies. According to the bill analysis, the changes include "requiring the agency to verify that the rule complies with the underlying statutory authority and legislative intent; expanding the scope of fiscal impact statements; requiring that proposed rules be submitted to the appropriate legislative policy committee for approval; permitting JLCAR to deny adoption of a rule following final objection, and repealing certain exemptions from rulemaking authority."
The House simplified the bill. The according to the amended bill analysis, "This bill directs agencies to notify legislative policy committees and known stakeholders of proposed rulemaking." The bill also directs the agency to pay attorneys fees if the agency adopted rules after final objection by the Joint Legislative Committee on Administrative Rules (JLCAR) and a court finds the rules are invalid.
