Repeal requirement for medical evaluation of intoxication after getting jailed
Summary:
Amends the procedures for law enforcement when they encounter someone who is both intoxicated and incapacitated by either alcohol or drugs. In general, this bill directs officers to pursue alternatives to putting the person in a county jail.
The House rewrote the bill. The new bill repeals the requirement for a drug counselor or other medical staff to assess if a person is really intoxicated after they are placed in jail for intoxication. According to the House Criminal Justice and Public Safety Committee, there are not staff available 24/7 to complete this evaluation, and the requirement is unnecessary.
